Terms & Conditions

Onyx Fine Instruments is a wholly owned brand of Able Scientific. All transactions, invoicing, and customer service are managed through Able Scientific to ensure a seamless purchasing experience. By placing an order through Onyx Fine Instruments (onyxfi.net), you acknowledge that Able Scientific is the parent company and the legal entity processing payments and handling fulfilment.

1. Reservation of Title

a) The ownership of the goods offered by Onyx Fine Instruments to the customer is only transferred to the customer when the customer has paid all sums owing to Onyx Fine Instruments, whether under this or any other contract and until such time Onyx Fine Instruments has the right to call for or recover the goods (for which purpose Onyx Fine Instruments) may enter the premises through its servants or agents). The customer is obliged to deliver the goods to Onyx Fine Instruments.

b) Where Onyx Fine Instruments is required to recover the goods from the customer's premises, the customer will bear all costs incurred.

 

2. Prices

a) Prices may be subject to change without notice, and goods will be invoiced at the price ruling on the dispatch date.

b) Any reference to retail prices is a recommendation only, and there is no obligation to comply with any recommended prices.

c) All invoices for purchases made on Onyx Fine Instruments (onyxfi.net) will be issued by Able Scientific. Payments will be processed through Able Scientific, ensuring a seamless purchasing experience.

 

3. Interest

Interest will be charged against all overdue accounts. Such interest to be charged and debited to the customer's account for the overdue balance will be variable.

 

4. Clerical Errors

Clerical errors are subject to correction without notification.

 

5. Variation

These trading terms are subject to change without notice.

 

6. Acceptance

Where payment has yet to be made in advance, all orders are subject to Onyx Fine Instruments' acceptance.

 

7. Force Majeure

Suppose in the performance or observance of its obligations, the Seller is prevented, restricted, or affected because of a force majeure, including strike, lockout, industrial dispute, new material shortage, breakdown of plant, transport or equipment, or any other cause beyond the reasonable control of the Seller. In that case, the Seller may, in its absolute discretion, give prompt notice of such cause to the Buyer; after that, the Seller is excused from such performance or observance to the extent of such prevention, restriction, or affectation.

 

8. Default of Buyer

a) If the Buyer does not strictly observe these terms and conditions, the Seller may, in its absolute discretion, refuse to supply to the Buyer. The Seller shall not be liable to the Buyer for any loss or damage the Buyer may sustain due to such refusal.

b) The costs of collection of any monies due and payable by the Buyer, including the fees of any Mercantile Agent or Solicitor engaged by the Seller, shall be payable by the Buyer.

 

9. Buyer's Cancellation

Unless otherwise agreed in writing, the Buyer shall have no right to cancel an order the Seller accepts. If a right of cancellation is expressly reserved to the Buyer, such right of cancellation must be exercised by notice in writing from the Buyer to the Seller not less than seven (7) days before the estimated date of shipment by the manufacturer or the Seller as the case may be unless otherwise agreed between the Buyer and the Seller.

 

10. SHIPPING COSTS

Orders placed online that are 20kg or over are subject to a mandatory shipping cost quote. This applies even if the Onyx Fine Instruments website (onyxfi.net) accepts the Buyer's order and payments. Free shipping is only offered if a special arrangement exists between the Buyer and the Seller. This will not be honoured if the Onyx Fine Instruments website (onyxfi.net) accepts the buyers' order and payment without issuing a shipping fee.
